ERISA Claims Have Limitations
The process for disputing denied of claims under plans that fall within the Employee Retirement Income Security Act of 1974 (ERISA) is much more stringent and places additional limitations on the claimant:
- In an ERISA claim, one cannot dispute that an insurance carrier is acting in bad faith in denying the claim
- There is a shorter time limit to appeal a denied ERISA claim (180 days)
- ERISA-based plans are also exempt from state regulations
